SBIC’s
Small Business Investment Companies (SBIC’s), setup by Congress in 1958, act as private companies, provide equity and long-term loans to small businesses, especially those with social or economic disadvantages.
Interest rates on these loans are considerably higher than conventional loans, varying from 12 percent to 18 percent, often requiring credit points as well. Loans are made on a 65 percent to 70 percent LTV (loan to value ratio) to retain ample equity in the property for the private lender, in case of default.
Simultaneous closings
A simultaneous closing allows a home seller to provide a property owner financing, without having any mortgage. The property title is passed to the buyer on the closing day and at the same time the newly created (owner) mortgage is sold for cash to a noted lender.
Subject-to-subject transaction
This is a Creative Financing Options in which a borrower may take title to a property in the conventional manner without receiving a loan. The transaction typically involves the property’s seller leaving their existing financing in place. This process is similar to assuming a loan, but varies because it usually occurs without the original lending institution’s permission and breaches the terms of the loan. This strategy is useful because it allows the borrower the ability to obtain credit without the need for transactional costs and does not tie up money in order to get a new loan. The strategy also helps the borrower to easily purchase property without going through the arduous process of loan origination.
Land Trust
A land trust is an arrangement by which one party (the trustee) agrees to own a piece of real estate property for the benefit of another party (the recipient). Land trusts are used by non-profit organizations to maintain easements for conservation, by companies and investment groups to collect large tracts of land, and by individuals to keep their ownership of real estate private, escape prosecution and provide several other benefits.
A land trust may be used in applying creative funding to take control of a property while keeping the owner’s name private. While this does not preclude the lending institution from enforcing the due on sale clause, the lending institution may find it more difficult to detect that the property was sold using innovative financing.
Short sale
In a short sale, the seller is often behind several payments and may even be close to bankruptcy, the seller may also experience major difficulties that have resulted in them being unable to continue making payments on the land. The seller must send a contract to the short sale buyer to purchase the property, a deed that is likely to be placed in escrow, giving them power of attorney and a variety of other documents that will place them in full control over the property. The investor will then present a case to the bank, holding the mortgage, that the seller is no longer able to make payments, has relinquished control of the property and that the loan on the property has to be reduced for the investor to buy the property.
The word “short sale” is a misnomer, because in the financial sense it has nothing to do with cutting something smaller. Also, such sales can take a considerable amount of time so for that reason it is also not considered a “fast sale”. The process, however, is shorter than the traditional process of hedging and selling through auction, which is still likely to take much longer.
